Abstract
During the last decade, European competition law went through several procedural changes, which were mainly influenced by US-American law. Economic criteria rather than legal parameters are now used to evaluate the conduct of firms. Such a “more economic approach” is apparent both in legislation and jurisdiction.
The article discusses the reforms that resulted from the paradigm shift by focusing on the legislation perspective as well as their impact in terms of cartels. One of the most important instruments in European competition policy is nowadays the Leniency Regulation, which was implemented in 1996. Another tool are the renewed Fining Guidelines, which in general will lead to higher fines.
Although European competition law adopted some instruments from American law, there are still major differences between the two jurisdictions. The possibility to impose jail sentences does not exist on a European level yet. However, a few European countries included criminal sanctions in their national laws.

Reform of Local Municipal Structures: Centralization not only Implicates Advantages

Abstract
The question whether centralized or decentralized municipal structures are more efficient has been discussed, not only in Germany, for a long time primarily under aspects of law and administrative sciences. In this article, we use an economic approach instead. The prevailing theories on interjurisdictional competition are not conclusive about the cost and welfare effects of centralization. Therefore, using the example of Saxony-Anhalt we investigate empirically if there are any significant differences in expenses or personnel between more centralized municipal governance forms (“Einheitsgemeinden”) or rather decentralized forms (“Verwaltungsgemeinschaften”). Our cross-section analysis for selected municipal activities reveals that both types are very similar in their cost and manning structures. Significant differences can be explained rather by different population densities than by the organizational structure. Considering these results we do not recommend a forced amalgamation of the municipalities in Saxony-Anhalt. Especially, if frustration cost or the political transaction cost, which both rise with centralization, are taken into account.

Abstract
Based on theoretical considerations about the “third mission” of universities and the discussion of the nature of different university-industry relations, we conclude that the entrepreneurial university is a manifold institution with direct ways to transfer technology from academia to industry as well as indirect connections to industry via entrepreneurship education and training. While existing literature usually deals with one or another linking mechanism separately, our central hypothesises is that direct and indirect mechanisms should be interrelated and mutually complementary. We emphasize the importance of a more holistic view and empirically investigate the scope and interrelatedness of entrepreneurship education and direct technology transfer mechanisms at German universities. We find a variety of activities in both fields and evidence for an identification of HEI with the mission of knowledge commercialisation. Furthermore, it shows that the HEIs’ technology transfer facilities and the entrepreneurship education providers co-operate in support of the creation of spin-offs and innovative start-ups.

Does Qualification Drive Innovation? A Microeconometric Analysis Using Linked-employer-employee Data

Abstract
Degree-level science and engineering skills as well as management and leadership skills are often referred to as a source of innovative activities within companies. Broken down by sectoral innovation patterns, this article examines the role of formal education and actual occupation for product innovation performance in manufacturing firms within a probit model. It uses unique micro data for Germany (LIAB) that contain detailed information about innovative activities and the qualification of employees. We find significant differences of the human capital endowment between sectors differentiated according to the Pavitt classification. Sectors with a high share of highly skilled employees engage in product innovation above average (specialized suppliers and science based industries). According to our hitherto estimation results, within these sectors the share of highly skilled employees does not, however, substantially increase the probability to be an innovative firm.

Abstract
In response to the question what secures Europe’s future competitiveness, it is often in the context of “knowledge society” referred to location advantages for research and development (R&D), innovation and knowledge. Respective point of view is not only represented by decision makers of high-duty industrial countries, but also by so called catching up economies in Central and Eastern Europe as well as Asia. The present article deals against the background of current innovation theoretic approaches with the question of what indeed constitutes the abstract notion of the knowledge society, which actors play a role and how R&D and innovation are geographically distributed. Systemic approaches are outlined, which place emphasis on the relation among different knowledge generating actors, in particular among science and economy. In effort to elucidate the geographical distribution of R&D and innovation the authors refer to the regional economic theory, which constitute the reasons why such processes are marked by spatial concentration. Thereby, the hypotheses are competing in associating the spatial concentration with either sectoral specialization or diversification. The article shows the domination of multinational companies of research and development (R&D) in the private sector and that these businesses connect regional centers of innovations beyond national borders. Based on the theory of technological accumulation and internationalization of companies, the globalization of R&D and innovation processes are explained. Thereby, it must be recognized that a hierarchy of regional innovation systems is emerging in which the disparities are increasing both at home and abroad.

Abstract
Many empirical studies consider either training activities of the unemployed or training activities of the employees in Germany. However, a comprehensive comparison of both groups is missing. The paper closes this gap. Using data of the latest time use survey (Zeitbudgeterhebung) of the Federal Statistical Office, the amount of training is compared for both groups. Furthermore, it is described which types of activities are made use of in particular. Heterogeneity due to different relevant socioeconomic characteristics in the two groups is eliminated by the appliance of a matching procedure. Findings demonstrate that only 49% of the unemployed persons participate in any kind of training activities off the job. In case of the full-time employment 59 % would take part. Concerning the average expenditure of time per week the difference turns around, i.e. the expenditure of time is higher during unemployment. However, a high proportion of the training activities of the unemployed falls upon general training, e.g. by reading books or watching TV. Furthermore, the result is driven by a different potential of time that can be used for training activities off the job. Relating to this potential of time the amount of training activities is still lower during unemployment.

Banking Regulation: Minimum Capital Requirements of Basel II Intensify Transmission from Currency Crises to Banking Crises

Abstract
Emerging market currency crises are often followed by banking crises. One reason for the transmission is the increased value of foreign debt measured in local currency. Equity capital is often insufficient to ensure liquidity. This problem is addressed by Basel II, in particular by its minimum capital requirements. In difference to the current regulation (Basel I), Basel II employs a differentiated risk weighing on base of credit ratings. This contribution calculates the hypothetic effects of the new regulation on minimum capital requirements for the example of the South Korea currency and banking crises of 1997. The results are compared to current regulation. It can be shown that minimum capital requirements in the case of Basel II would have been lower than in the case of Basel I. Additionally, minimum capital requirements would have increased dramatically. The transmission from currency to banking crises would not have been prevented, but would have been accelerated. Thereby, minimum capital requirements under Basel I have been relatively low because of South Korea’s OECD membership. It can therefore be concluded that in other emerging market economies, which are not OECD members, the ratio of minimum capital requirements of Basel II to the minimum capital requirements of Basel I prior the crises would have been even lower. Therefore, the new instrument of banking regulation would have intensified the transmission from currency to banking crises.

Urban Consolidation in Saxony a Thread for the Historic Districts?

Abstract
Different lobby groups that fear a discrimination of the old and historic housing stock with its cultural value recently challenged the success of the urban renewal program „Stadtumbau Ost“. To make the discussion about it more objective, the subsidies for deconstruction and for improvement of the program are examined for the Free State of Saxony. The descriptive empirical analysis shows that the deconstruction of old houses mainly took place in cities with a higher share of old houses. Insofar, the danger of a total loss of the old housing stock may be low. Considering the allocation of the improvement subsidies, it can be shown that areas with old housing do profit relatively more, but not so often like the prefabricated socialist residential areas of the former GDR. The development of the historic housing stock, an explicit goal of the program “Stadtumbau Ost”, has been carried out in a minor degree in favour to the goal of housing market-adjustment.

Abstract
The paper investigates the number and structure of available jobs by gender in East and West Germany, the gap between the supply and demand of jobs by gender in both regions and the reasons for the wider “job gap“ in East Germany compared with West Germany. The analysis shows no significant difference in the number of jobs per 1000 persons in working age between East and West Germany. For women, the East German economy offers more jobs. Nevertheless, the gap between labour demand and the supply of jobs is wider in East germany. This is caused not only by problems concerning the production structure, but also by the significantly higher participation rate of women in the labour market. Reasons are the traditional behaviour of East German women and - compared with West germany - the considerably lower household income.

Asset Tangibility and Capital Allocation

Abstract
Firms comprise divisions that often differ with respect to the degree of asset tangibility. As the strength of borrowing constraints depends on the liquidation value of assets, these firms influence their debt capacity by allocating funds across divisions. We argue that a company whose capital allocation is not verifiable suffers from a dynamic inconsistency problem, as it tends to allocate resources in favor of divisions with fewer tangible assets, leading to a tight borrowing constraint. When capital allocation is verifiable, committing to invest only little there eases this constraint, although it implies a deviation from a return maximizing allocation.
